1. Acceptance of Terms
By accessing or using OperatiqAI (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Service
OperatiqAI provides an AI-powered business intelligence platform including document analysis, AI chat assistants, analytics dashboards, and API access. Features and availability may vary by subscription plan.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and all activities under your account. Notify us immediately of any unauthorized access.
4. Subscription & Billing
Paid plans are billed monthly or annually. You authorize us to charge your payment method on file. Plans auto-renew unless cancelled before the renewal date. Refunds are issued on a case-by-case basis within 14 days of purchase. Usage-based charges (including BYOK passthrough) are billed at the end of each billing cycle.
5. Bring Your Own Key (BYOK)
When you choose to use your own AI provider API keys, you are responsible for compliance with that provider's terms of service and usage policies. OperatiqAI acts as a passthrough and is not liable for charges incurred on your provider accounts. You acknowledge that response quality and availability depend on your chosen provider.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious files or attempt to compromise system security
- Reverse engineer, decompile, or disassemble the Service
- Resell or redistribute access without authorization
- Exceed rate limits or abuse API access
- Upload content that violates intellectual property rights
7. Intellectual Property
You retain ownership of all data and documents you upload. OperatiqAI retains ownership of the platform, AI models (excluding third-party models), and all proprietary technology. AI-generated outputs based on your data are owned by you.
8. Service Level Agreement
Enterprise plans include a 99.99% uptime SLA. Professional plans target 99.9% uptime. Scheduled maintenance windows are communicated 48 hours in advance. Credits are issued for downtime exceeding SLA commitments.
9. Limitation of Liability
OperatiqAI is provided “as is.” We are not liable for any indirect, incidental, or consequential damages. AI-generated outputs are not guaranteed to be accurate and should not be used as the sole basis for critical business decisions. Our total liability shall not exceed the fees paid in the 12 months prior to the claim.
